Website Terms of Use
Last updated: [date]
1. About these terms
Welcome to wheelandanchor.ca. This website is operated for Vancouver Regency Travel Ltd. ("VRTL") by its affiliate Wheel & Anchor Inc. VRTL is a travel retailer registered with the Travel Industry Council of Ontario (TICO Reg. 1817786) and operates as Wheel & Anchor and New Sky Travel. All trips offered on this website are sold by VRTL. In these terms, "Wheel & Anchor," "W&A," "we," and "us" mean VRTL and Wheel & Anchor Inc. By using this website, including requesting a booking through it, you agree to these Terms of Use. If you don't agree, please don't use the site.
These terms cover your use of the website and booking through it. They do not cover the trips themselves. Every trip has its own booking terms, which we provide to you separately and which govern that trip, including payments, changes, and cancellations. If anything here conflicts with a trip's booking terms, the booking terms win for that trip.
2. Using the website
You may browse this site and use it for its intended purpose: learning about W&A, exploring trips, contacting us, and booking. You must be at least the age of majority where you live to book a trip. We don't advertise in Quebec, and this website, our policies, and our booking documents are available in English only.
3. Booking through the website
When you submit a booking through the site, you are making a request. Before you submit, we'll show you the booking terms for your trip and its total price, ask you to accept the booking terms, and let you review and correct your details. Your booking is not confirmed until we confirm it to you in writing. We'll send you your booking confirmation and a copy of your booking terms.
When you book, you agree to:
- Give us accurate and complete information, including traveller names exactly as they appear on passports.
- Have the authority to book for everyone on the booking. If you book for a companion or another traveller, you confirm they have authorized you to share their information and to book on their behalf, and you'll let them know how we handle their information, as described in our Privacy Policy.
For what you owe, when, and what happens if plans change, see the booking terms for your trip.
4. Payments
All payments are made to VRTL and deposited in its trust account, as Ontario's Travel Industry Act, 2002 requires. Card payments are processed for VRTL by [payment processor], which meets the Payment Card Industry Data Security Standard (PCI DSS), and appear on your statement as WHEELANDANCHOR.CA. Payment information is handled in accordance with Canada's privacy laws and our Privacy Policy.
The amounts due and the dates they are due are set out in your trip's booking terms and your tour confirmation.
5. Information on this website
We work to keep the site accurate and current, but trip details, prices, availability, itineraries, and photos may change or contain errors. Prices are shown in Canadian dollars and include all taxes, fees, and service charges, and any conditions that affect a price (such as double occupancy or travel dates) are shown with it. If we find a price error before we confirm your booking, we'll tell you, and you can go ahead at the correct price or cancel for a full refund. Availability notes (such as "Book Soon") reflect bookings at the time and can change quickly. Trip details are final only once confirmed in your tour confirmation.
6. Acceptable use
Please don't:
- Use the site in a way that is unlawful, harmful, or interferes with others' use of it.
- Try to gain unauthorized access to the site, our systems, or our data.
- Copy or collect content from the site by automated means (scraping, bots) without our written permission.
- Introduce viruses or other harmful code.
7. Intellectual property
The website and its content, including text, itineraries, photos, graphics, logos, and the Wheel & Anchor name, belong to W&A or our licensors and are protected by copyright and other laws. You may view and print pages for your personal, non-commercial use. Any other use, including copying, republishing, or selling content, needs our written permission.
8. Links to other websites
This site may link to websites run by others, such as insurers, suppliers, or government travel advisories. We don't control those sites and aren't responsible for their content or practices. Their terms and privacy policies apply when you use them.
9. Disclaimers and limits of liability
We take care to keep this website accurate, secure, and available, but we can't promise it will always be uninterrupted or free of errors. As far as the law allows, W&A is not liable for indirect or consequential losses, such as lost data or lost opportunity, caused by using or being unable to use this website. This section covers the website only. Your rights and our responsibilities for a trip are set out in that trip's booking terms. Nothing in these terms limits any liability that the law does not allow to be limited, or any right you have under the Travel Industry Act, 2002, the Consumer Protection Act, 2002 (Ontario), or the consumer protection laws of the province or country where you live.
10. Privacy and cookies
How we collect, use, and protect your personal information, and how we use cookies, is described in our Privacy Policy.
11. Member conduct
How members are expected to treat each other is set out in our Policy Against Discrimination and Harassment. Expectations for travellers on trips are set out in The Wheel & Anchor Way, which forms part of your booking contract.
12. Changes to these terms
We may update these terms from time to time. The current version is always posted on this page with its "last updated" date. Continuing to use the website after a change means you accept the updated terms. Changes don't affect a booking we have already confirmed.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. This may not take away any protection you have under the mandatory consumer protection laws of the province or country where you live, but as our trips are primarily intended for Canadians and/or residents of Canada, our position is that the standards applied in Canada shall be deemed to apply.
14. Questions and complaints
If you have a question or concern about the website or a booking, please contact us first, and we'll do our best to resolve it. If we can't, you can contact the Travel Industry Council of Ontario (TICO) at tico.ca.
